Brett J. Miller, 43, of Creston, was taken into custody 10:53 p.m. Jan. 1, in the 600 block of New York Avenue on the charge of OWI, first offense.

According to a Creston Police report, at approximately 10:25 p.m. a 2002 GMC Envoy was stopped for having a license plate lamp out. Contact was made with the driver, identified as Miller, who made statements about celebrating a friend’s birthday.

Miller was observed to have bloodshot, watery eyes, slurred speech and the odor of an alcoholic beverage coming from his person. Miller also made statements admitting to consuming alcoholic beverages earlier in the evening.

Miller consented to field sobriety testing and showed clues of impairment. A PBT indicated his BrAC to be above .08%.

Miller later consented to provide a breath specimen for chemical testing, resulting in a .105% BAC.

Miller was transported to the Union County Jail where he was released from after posting $1,000 cash or surety bond.
