Daniel B. Busenbarrick, 38, of Creston, was taken into custody 11:56 p.m. Oct. 2, at Clark and Elm streets on the charges of OWI, third or subsequent offense, possession of a controlled substance - methamphetamine; possession of a controlled substance, first offense and possession of drug paraphernalia.

According to a Creston Police report, at approximately 11:10 p.m. a 2008 Chevrolet Trailblazer was observed traveling 33 mph in a 25 mph zone. A traffic stop was conducted and contact was made with the driver, identified as Busenbarrick. Officers observed a glass containing an alcoholic beverage in the vehicle and a marijuana pipe with residue in Busenbarrick’s lap.

A probable cause search was conducted resulting in officers locating two baggies containing a crystalline substance, a second marijuana pipe and a baggie containing three pills including Tequin, a prescription only medication and Tramadol, a Schedule 4 controlled substance. The crystalline substance later field tested positive for methamphetamine.

Busenbarrick admitted to consuming alcohol earlier in the day as well as smoking marijuana. He consented to field sobriety testing and Advanced Roadside Impaired Driving Enforcement tests and showed validated signs of impairment. A PBT showed his BrAC under the legal limit.

Busenbarrick was transported to the Union County Law Enforcement Center where he consented to provide a urine sample for chemical testing. He was evaluated by a Creston Police Department Drug Recognition Expert and showed various signs of impairment.

Busenbarrick was transported to the Union County Jail and held on $7,000 cash or surety bond.
