Juan Calderon Estrada, 33, of Omaha, Nebraska, was taken into custody 6:48 p.m. Oct. 29 in Adair on the charge of OWI, first offense.

According to an Adair Police report, at approximately 4:45 p.m. a broadcast was made on a GMC Sierra westbound on Interstate 80, unable to maintain its lane and traveling at erratic speeds. Adair Police located the vehicle near mile marker 76, when the Sierra saw the patrol car, it quickly changed lanes and followed a vehicle too closely. When the patrol unit was able to get behind the truck, it again changed lanes rapidly, failing to use continuous signal and followed a semi too close.

A traffic stop was initiated. When the truck pulled over, it failed to get completely off the roadway and was partially in the slow lane of the traveled portion. When the driver rolled down the window, officers immediately detected a strong odor of an alcoholic beverage coming from the vehicle. There was a language barrier but Estrada was asked to exit the truck and go to the patrol vehicle and Estrada understood and complied.

While in the patrol vehicle, officers again detected a strong odor of an alcoholic beverage. Estrada also had bloodshot, watery eyes. Officers used a translator application to speak more with Estrada, during which time he agreed to field sobriety testing. Those tests showed clues of impairment. He was asked to perform more tests and refused saying he just wanted his citations so he could leave. A PBT resulted in Estrada blowing above the legal limit.

While retrieving Estrada’s cell phone for him, officers observed an open beer can in the driver’s door and two more in the center console.

Estrada was transported to the Adair County Jail where he consented to provide a breath sample for chemical testing, the result of which indicated a BAC of .161%.

Estrada was released from the Adair County Jail after posting $1,000 cash or surety bond.
