Moises Plaza, 41, of Des Moines, was taken into custody 2:30 a.m. Oct. 23 in the 400 block of Washington Street in Fontanelle on the charges of OWI, third offense and driving while barred.

According to an Adair County report, at approximately 1:44 a.m. deputies observed a 2013 Toyota Avalon traveling westbound on Washington Street at 44 mph in a 25 mph zone. Deputies initiated a traffic stop, the Avalon slowed down but did not immediately stop. While following the Avalon, it did not driven in a straight line. After driving four or five blocks, the Avalon pulled into the co-op parking lot.

After approaching the passenger-side of the vehicle, deputies observed an open beer can in the center console area. Deputies motioned to the driver, later identified as Plaza, to roll down the window, but he instead he reached over and attempted to open the door but couldn’t, so the deputy opened the door for him.

Plaza said he didn’t know how much he had to drink and did not have a license. Plaza had slurred speech and had a difficult time opening the glove box to get insurance documents. The documents he retrieved and threw on the seat were not insurance papers and nothing else in the glove box appeared to be.

Plaza was asked to step out of the vehicle. He had a difficult time exiting the car and was unsteady walking to the patrol vehicle. Before deputies could explain anything, Plaza turned around, put his hands behind his back and said “Do what you gotta do.” He refused all field sobriety tests and a PBT test.

After being transported to the Adair County Jail, Plaza informed deputies he would not answer any questions and said he was ready to go to jail. He struggled with his balance while walking and a difficult time putting on the jail uniform.

Plaza was found to have two OWI convictions within the previous 12 years and his drivers license was barred.

Plaza was released from the Adair County Jail on $5,000 cash or surety bond.

Joseph Daniel-Lee D. Bond, 28, of Orient, was taken into custody 5:42 p.m. Oct. 24 in the 2700 block of 300th Street on a Polk County warrant for violation of probation on the original charge of domestic abuse assault impeding flow of air/blood.

According to Polk County documents, Bond was granted a suspended sentence including probation on the original charge and violated the terms of his probation.

Bond was transported to the Adair County Jail and was released to the custody of Polk County.

Cory D. Hansen, 20, of Adair, was taken into custody 5:50 p.m. Oct. 27 in the 400 block of 4th Street in Adair on a Dallas County warrant for the charges of assault and criminal mischief, first degree.

Hart was immediately transferred to the custody of Waukee Police Department.

Billy G. Hart, 49, of Urbandale, was taken into custody 7:41 p.m. Oct. 28 on Interstate 80 on the charge of OWI, first offense.

According to an Iowa State Patrol report, at approximately 6 p.m. Oct. 28, troopers were notified of a 2020 Jeep Cherokee speeding, passing vehicles on the right and driving aggressively, near mile marker 70 of eastbound Interstate 80. A trooper located the vehicle near mile marker 76, traveling 75 mph in a 70 mph zone, the Jeep also had expired registration tags.

A traffic stop was initiated and contact was made with the driver, later identified as Hart, who had a strong odor of an alcoholic beverage from inside his vehicle. Hart had slurred speech and bloodshot, watery eyes. He was asked to sit in the patrol car while paperwork was being done, while walking, his balance was observed to be impaired. While seated in the patrol unit, a strong odor of an alcoholic beverage was detected coming from his person.

Hart consented to field sobriety testing which indicated clues of impairment. A PBT resulted in a Brac of over .08%.

Hart was transported to the Adair County Jail where he consented to to provide a sample of his breath to be tested on the datamaster. The test result indicated a BAC of .163%.

Hart was cited and released on a summons to appear.

Aurelio S. Sempek, 27, of Johnston, was taken into custody 11:52 p.m. Oct. 28 on Interstate 80 on the charges of OWI, first offense; possession of a controlled substance - marijuana, first offense and possession of drug paraphernalia.

According to an Adair Police report, at approximately 11:36 p.m., a 2004 Acura was observed parked on the onramp at the 76 mile marker of Interstate 80 with no lights on. As officers drove toward the vehicle, it began to drive away still without its lights on. Once officers got behind the car, it quickly turned on its lights and proceeded westbound on the interstate.

While following the vehicle, officers observed it weaving in its lane, cross the center line and the fog line multiple times. A traffic stop was initiated and contact was made with the driver, identified as Sempek, and the odor of an alcoholic beverage was detected coming from the vehicle. Sempek had slurred speech and bloodshot, watery eyes. A open alcoholic beverage was observed in the center console cupholder. Sempek consented to field sobriety testing, which provided clues of impairment, and a PBT test result showed a BrAC over .08%.

A probable cause search of the vehicle was conducted. An open package of Fireball Whiskey shooters were found on the passenger-side floorboard, two of the shooters were in the center console, one of which was partially drank and a plastic container containing a baggie with a green, leafy substance, believed to be marijuana, and a grinder were located in the center console.

Sempek was transported to the Adair County Jail where he was released from after posting $2,300 cash or surety bond.
