When they arrived, they observed an unresponsive female in the driver’s seat of a 2009 Pontiac G6. The vehicle was running and the female was wearing her seatbelt.

Officers reached into the vehicle, turned it off, removed the keys and placed them on the hood of the vehicle. After waking her up, the driver, identified as Rodriguez, told officers she had been at a friend’s house where she had consumed a few drinks but believed she was at her house and could not remember what time it was.

After originally consenting to perform testing at the law enforcement center, Rodriguez changed her mind and wanted to complete the testing in the rain. She completed two testing and showed clues of impairment in each. She refused PBT testing.

When Rodriguez was advised she was being taken into custody, she became belligerent and argumentative. Rodriguez was taken to the restroom and was then removed from it after finding out she would be observed in the room. She then urinated in an office of the law enforcement center. Rodriguez yelled racial slurs in English and Spanish at officers throughout the interaction and urinated on the floor a second time before being taken to the jail.
