Matthew Christopher Avila, 25, 3369 Delta Avenue, of Prescott, turned himself in on an Adams County warrant for operating while intoxicated Nov. 15 at the Adams County Sheriff’s office.
According to an Adams County Sheriff’s report, the original incident took place during an OnStar call reporting a collision Oct. 18. Avila had lacerations on his face that needed medical attention. Avila smelled of alcohol and said there were three more people in the back seat. The deputy discovered there were actually no more passengers. An investigation discovered Avila left the driver’s seat, went around the vehicle and sat in the passenger’s seat. There were only blood markings in the driver’s and passenger’s side seats and there was a large wooden box in the backseat rendering the space inadequate to hold passengers. The medical team assisting Avila found vehicle keys in his pocket. Avila was taken to the Corning CHI, but was not given medication and the deputy was told to wait for imaging results before he could speak to him. Avila’s father asked the deputy to leave so he could get medical treatment. The deputy couldn’t get implied consent because Avila was incapacitated, so he asked for a search warrant for his blood. The warrant was acquired and Avila was informed so his blood could be sent to the DCI. Avila’s BAC was .165.
