Kurtis Fooken, 25, 307 North St., was charged with driving while suspended and second-offense operating while intoxicated 2:40 a.m. Saturday at Casey’s General Store, 801 W. Taylor St.

According to a Creston Police report, as officers were leaving Casey’s parking lot, they saw a red truck pull into the lot and recognized the driver as Fooken. Officers knew Fooken’s driver’s license was suspended and pulled back into the parking lot. Officers parked and approached Fooken while he was still seated in his vehicle. Fooken said he was suspended and a check of his license confirmed he was suspended for non-payment of an Iowa fine. As officers spoke to Fooken, they smelled the odor of an alcoholic beverage and noticed his speech was slurred and his eyes were bloodshot and watery. Fooken consented to a field sobriety test and showed significant signs of impairment. Fooken was offered the preliminary breath test and refused the test, and refused the Data Master test.

Fooken was released on $2,000 bond.
